Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Scobo (“the App”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not install, access, or use the App. We may update these terms, and continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years of age, or 16 if you reside in the European Economic Area (EEA). By creating an account, you represent that you meet this age requirement and that any information you provide is accurate and complete. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf.

3. Account Registration and Security

You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your account, create multiple accounts, or allow any third party to access your account. You are fully liable for all activity occurring under your account, whether authorized or not. Notify us immediately at scoboapp@gmail.com of any unauthorized use.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes only. You agree not to:

• Copy, modify, reverse-engineer, or create derivative works of the App
• Use automated tools, bots, scripts, or scrapers to interact with the App
• Interfere with or disrupt the App, servers, or networks
• Attempt to bypass any security or access-control measures
• Use the App for any unlawful purpose or in violation of any applicable law

5. Description of Service

Scobo is a skill-based social sports prediction game. Users predict live match events and earn points based on accuracy and event probability.

6. User Conduct and Content

You are solely responsible for any content you submit, including your username and display name. You agree not to:

• Use offensive, obscene, or infringing usernames
• Harass, threaten, impersonate, or abuse other users
• Submit content that violates any law or third-party right

We reserve the right, at our sole discretion and without notice, to:

• Remove or modify any user content
• Suspend or terminate any account for violating these terms
• Report violations to relevant authorities if required by law

7. Predictions and Scoring

All predictions are final once submitted. Scores are calculated based on event outcomes and probabilities derived from third-party sports data. We make no guarantee — express or implied — regarding the accuracy, completeness, timeliness, or availability of any sports data. Technical errors, delays, or inaccuracies in third-party data shall not give rise to any liability on our part.

8. Leaderboards and Social Features

Your username, scores, rankings, and league memberships are public within the App. You may not opt out of leaderboard visibility while maintaining an active account. You acknowledge that leaderboard data may be used for promotional purposes.

9. Intellectual Property

The Scobo name, logo, design, code, and all proprietary content are owned by Scobo or its licensors. No license or right is granted except as expressly set forth in Section 4. All rights not expressly granted are reserved.

10. Third-Party Services

The App integrates with third-party services including Google Firebase (authentication, data storage, push notifications), ESPN API (live sports data), and YouTube Data API (video content). We are not responsible for the availability, accuracy, security, or operation of any third-party service. Your use of these services may be subject to their own terms and privacy policies.

11. Push Notifications

With your permission, we may send push notifications. You may opt out at any time via device settings. Opting out may affect your experience (e.g., missed match updates).

12. Privacy

Your use of Scobo is governed by our Privacy Policy, which is incorporated into these terms by reference. For EEA users, our lawful basis for processing personal data is your consent and the performance of these terms.

13. Indemnification

You agree to indemnify, defend, and hold harmless Scobo, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these terms
• Your violation of any applicable law or third-party right

14. Disclaimers and Limitation of Liability

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCOBO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF POINTS, LOSS OF DATA, LOSS OF RANKINGS, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, OR OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, pandemic, third-party API outages, internet service failures, or power outages.

16. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice, at our sole discretion. Upon termination:

• Your license to use the App immediately ceases
• We may delete your account and associated data (subject to our Privacy Policy and applicable law)
• You are not entitled to any refund, compensation, or reinstatement of points or rankings

You may terminate your account at any time by contacting us or using in-app account deletion features.

17. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-laws principles.

Informal Resolution First

Before filing any claim, you agree to attempt to resolve the dispute informally by contacting scoboapp@gmail.com. We will respond within 30 days.

Arbitration

Any dispute arising out of or relating to these terms that cannot be resolved informally shall be finally settled by binding arbitration. The arbitration shall be conducted in English and the seat of arbitration shall be London, England.

Class Action Waiver

All claims must be brought in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative proceeding.

EEA Users

If you reside in the EEA, nothing in this section deprives you of the protection of mandatory consumer protection laws of your country of residence, and you may also bring claims in your local courts.

18. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and Scobo regarding your use of the App.
